Terms & Conditions apply to all orders placed with Barnby Design.
By purchasing from us, you agree to the terms set out below.

Barnby Design creates handcrafted furniture and design pieces. Many products are made to order.
Due to the nature of handcrafted work and natural materials:
Variations in wood grain, colour, texture, and finish are natural and not considered defects
Minor dimensional tolerances may occur
Nothing in these terms affects your statutory rights under UK consumer law.

Made to order items are goods made to your specification or clearly personalised.
Under the Consumer Contracts Regulations 2013, custom-made goods are exempt from the 14-day cancellation (cooling-off) period.
Therefore:
Orders for made to order items cannot be cancelled once production has begun
These items cannot be returned or exchanged unless faulty or damaged in transit
You are responsible for ensuring all measurements, specifications, and access requirements are correct before ordering.

Stock items are subject to availability. We reserve the right to withdraw or update products at any time.
If you purchase as a consumer online or at a distance, you may have the right to cancel your order within 14 days of receiving the goods under the Consumer Contracts Regulations, provided:
The item is not custom-made
The item is returned unused and in original packaging

Pricing
All prices are shown in GBP (£) and include VAT where applicable
Delivery charges are calculated separately unless stated otherwise
We reserve the right to change prices at any time, but confirmed orders will not be affected

Payment must be received in full (or agreed deposit paid) before production or dispatch. We reserve the right to delay or cancel orders where payment is not completed.

Delivery timeframes are estimates and not guaranteed. Delays may occur due to:
Material availability
Production schedules
Courier or freight issues outside our control
We are not liable for delays once goods have been dispatched.
You are responsible for:
Providing accurate delivery details
Ensuring safe and suitable access to the delivery address
Additional charges may apply for failed delivery attempts due to access issues or incorrect information.
Risk in the goods passes to you upon delivery.

Your rights under the Consumer Rights Act 2015 are not affected.
If goods arrive damaged or faulty:
You must notify us within 48 hours of delivery
Photographs of the item and packaging are required
If a product is confirmed to be faulty, you may be entitled to repair, replacement, or refund in line with your statutory rights.

Returns must follow our Returns Policy. Items must be returned unused and in the original packaging. We may reduce a refund if the value of the goods has been diminished due to handling beyond what is necessary to inspect them.

We are not responsible for damage caused by:
Misuse or improper use
Incorrect assembly
Normal wear and tear
Environmental conditions such as humidity, heat, or direct sunlight
Care instructions provided should be followed.

All designs, drawings, images, product names, and website content remain the intellectual property of Barnby Design and may not be copied or reproduced without written permission.

Nothing in these terms limits liability for:
Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation
Any matter that cannot legally be limited
Subject to this, our liability is limited to the purchase price of the goods.

Personal data is handled in accordance with our Privacy Policy and UK data protection law.

These Terms & Conditions are governed by the laws of England and Wales, and any disputes will be subject to the jurisdiction of the courts of England and Wales.
